I'm in Eaton Co. covering Lou Anna Simon's ongoing preliminary examination. First to the stand is Marti Howe, Simon's now-retired assistant. Defense attorneys questioning her about calendar keeping.
Attorney Lee Silver has Howe read agenda for meeting Simon had w/ Granberry-Russell in '14 (prosecutors say that's when she was told about Nassar). He reads the specific names she wrote down.
“The name Larry Nassar was not written by President SImon anywhere on this agenda."
Going through more meeting agendas. Attorney Lee Silver asks Howe whether Simon's notes indicate she and Granberry-Russell talked about items: Title IX, sexual assault cases or OCR investigation into MSU. Agendas from June & July meetings indicate those topics weren't discussed.
Simon's defense attorney Lee Silver is hammering this point: Larry Nassar's name does not appear on the agendas prosecutors say prove Simon was told about a Title IX investigation into Nassar's conduct.
According to Simon's notes, Granberry-Russell and Simon apparently didn't discuss agenda items 'sexual assault cases', 'Title IX implementation' and 'OCR investigation' very often in 2013 and 2014. They are on the agendas, but no indication they discussed them.
Simon's office was "hectic," Howe said. Back-to-back meetings, people would drop in and call, she was booked all day. Sometimes regularly scheduled meetings started late.
Scott Teter, from AG's office, returns to question Howe. He points out that Simon asked Howe which topics to put on the agenda (items like Title IX, OCR, sexual assault cases).
